Payday loans in Arizona: the rules and your way out
Typical payday loans not allowed
Arizona's payday (deferred presentment) law expired July 1, 2010 and was formally repealed in 2021, so consumer loans of $10,000 or less must be made by a licensed consumer lender at no more than 36% a year on the first $3,000.
Law: A.R.S. §§ 6-601 to 6-638 (consumer lenders), esp. §§ 6-603, 6-613, 6-632; former deferred presentment statutes (A.R.S. title 6, ch. 12, art. 2) terminated July 1, 2010 and repealed by Laws 2021 (SB 1463). Arizona Revised Statutes on azleg.gov (site offers sessions through 2026 Second Regular Session), read 2026-10-24
Arizona's rules, line by line
- Fee or rate cap
- Licensed consumer lenders: consumer loan rate of 36 per cent on loans of $3,000 or less; on larger loans 36% on the first $3,000 and 24% on the excess, or a blended rate (A.R.S. § 6-632(A)).
- State loan database
- No
- Limits on collection
- A consumer lender loan made by a person who must be licensed but is not is void, and that person has no right to collect, receive or retain any principal, finance charges or fees (A.R.S. § 6-613(B)). If a licensee charges more than allowed on a loan of $5,000 or less, the loan is voidable and the licensee may not collect principal, finance charges or fees (A.R.S. § 6-613(A)(1)).
If you are behind on a payday loan in Arizona
- Check whether the loan was legal to make. Arizona does not allow payday loans at typical payday prices. If a lender charged more than the state's limit, report it to the Arizona Department of Insurance and Financial Institutions (DIFI) through its complaint page.
- Stop the automatic withdrawals if they are emptying your account. You can revoke the lender's permission to debit your account and tell your bank. How to do it.
- Look at a credit union payday alternative loan. Federal credit unions can lend $200 to $2,000 at much lower cost. How they work.
- Talk to a nonprofit credit counselor. A counselor can look at all your bills, not just this one. How to find a real one.
