The plan has at least 4 substantially equal installments due on or after paydays, or at least two weeks apart if there is no regular income. No interest or extra fees while in compliance, and prepayment is allowed. No new payday loan may be made during the plan. Lenders must post and disclose that EPPs are available (16a-2-404(7)).
- State loan database

Holder takes subject to claims and defenses of maker. No criminal prosecution.' (16a-2-404(8)). No hold harmless or confession-of-judgment clauses, and no waivers of claims or defenses (16a-2-404(11)(d)).
- Other rights
- Right to rescind without cost by the end of the business day after the loan by telling the lender and returning the cash principal; the lender refunds any fees (16a-2-404(10)). Ability to repay is a factor in whether a loan is unconscionable (16a-2-404(9)). Lenders may not sell other products in connection with the loan (16a-2-404(11)(c)).
If you are behind on a payday loan in Kansas
- Ask for the payment plan before the due date. Kansas law gives borrowers a way to repay in installments. The details are in the table above. Ask in writing and keep a copy.
- Stop the automatic withdrawals if they are emptying your account. You can revoke the lender's permission to debit your account and tell your bank. How to do it.
- Look at a credit union payday alternative loan. Federal credit unions can lend $200 to $2,000 at much lower cost. How they work.
- Talk to a nonprofit credit counselor. A counselor can look at all your bills, not just this one. How to find a real one.
