Payday loans in Oklahoma: the rules and your way out

Only longer installment-style loans allowed

Oklahoma ended new deferred deposit (payday) loans on August 1, 2020; licensed small lenders may now make only unsecured installment loans of 60 days to 12 months, at up to 17% interest per month, with a $1,500 total cap per borrower.

Law: Oklahoma Small Lenders Act, 59 O.S. 3150-3150.27 (Laws 2019, SB 720, c. 89, eff. Nov. 1, 2019); 59 O.S. 3101.1 (end of new deferred deposit loans Aug. 1, 2020; Deferred Deposit Lending Act, 59 O.S. 3101-3119). Oklahoma's rules, line by line

Largest loan
$1,500 in total small-loan principal outstanding per customer across all licensees, adjusted every other year for inflation by the Administrator (59 O.S. 3150.10(C)); no loan if total scheduled payments due in a month exceed 20% of gross monthly income (3150.10(D)).
Shortest term
60 days (59 O.S. 3150.1(6)(b)).
Longest term
12 months (59 O.S. 3150.1(6)(b)).
Fee or rate cap
"A licensee may only charge and collect a periodic interest rate not to exceed seventeen percent (17%) per month unless otherwise provided by this title." (59 O.S. 3150.10(B)). Loans must be fully amortized in substantially equal periodic payments and prepayable without penalty (3150.1(6)). Licensees may not use any device to obtain greater charges (3150.12(C)).
Loans at once
No numeric limit; total outstanding small-loan principal across all licensees is capped at $1,500 (inflation-adjusted), checked in an approved database (59 O.S. 3150.10(C)).
Payment plan if you cannot pay
No statutory extended payment plan. Small loans are already installment loans; borrowers who default may get consumer credit counseling from a Department-approved list, which the lender must provide on request (59 O.S. 3150.11(C)).
State loan database
Yes. Lenders must verify outstanding balances using "a private database approved by the Administrator"; the provider may charge the lender up to $2.20 per 30-day period a balance is outstanding (59 O.S. 3150.10(C)). Name of the approved database not confirmed.
Limits on collection
Returned check, ACH or RCC payment: $25 fee (59 O.S. 3150.10(G)). Attorney fee after default and referral to an attorney: up to 15% of the outstanding amount, if the loan agreement provides (3150.10(F)). Electronic payments need written authorization and new written approval after a second failed attempt for insufficient funds (3150.10(E)). Licensees must follow the federal Fair Debt Collection Practices Act (3150.12(D)). No employer can be required to garnish wages to collect a small loan (3150.27). Default requires a missed payment of no more than 61 days per the agreement (3150.1(9)). Administrator may order refunds of fees collected in violation and fines of up to $1,000 per transaction (3150.16).
Other rights
Right to rescind through the close of business the day after the loan proceeds are disbursed (or the next day the lender is open) (59 O.S. 3150.11(B)(1)). Prepay in whole or in part at any time without penalty (3150.1(6)(d); 3150.11(A)). Loan agreements may not choose another state's law, jurisdiction or venue; such clauses are void (3150.12(E)). Online and phone lenders reaching Oklahoma consumers must be licensed (3150.2(A)). Written complaints may be filed with the Administrator (3150.19). Deferred deposit loans made before August 1, 2020 could still be collected under their original terms (3101.1).

If you are behind on a payday loan in Oklahoma

  1. Stop the automatic withdrawals if they are emptying your account. You can revoke the lender's permission to debit your account and tell your bank. How to do it.
  2. Look at a credit union payday alternative loan. Federal credit unions can lend $200 to $2,000 at much lower cost. How they work.
  3. Talk to a nonprofit credit counselor. A counselor can look at all your bills, not just this one. How to find a real one.
