Utah's rules, line by line
- Largest loan
- No statutory maximum found in Utah Code Title 7, Chapter 23.
- Longest term
- Lender may not collect additional interest 10 weeks after the loan is executed, and may not roll over a loan if repayment would fall more than 10 weeks after execution (Utah Code § 7-23-401(4)(a), (c)).
- Fee or rate cap
- No rate cap in the Act. Under the Utah Consumer Credit Code, parties 'may contract for payment by the debtor of any finance charge and other charges and fees' (Utah Code § 70C-2-101). Interest stops after 10 weeks (§ 7-23-401(4)(a)).
- Renewals and rollovers
- Allowed only at the borrower's request and only within the 10-week limit (§ 7-23-401(4)(b)-(c)); lender may not use a new loan to refinance around the 10-week limit (§ 7-23-401(4)(e)).
- Waiting period between loans
- No new loan on the same business day the borrower pays another loan in full if the combined terms would total more than 10 weeks of consecutive interest (§ 7-23-401(4)(d)).
- Payment plan if you cannot pay
- Yes. Lender must allow an extended payment plan at least once in a 12-month period on request, and must offer one after 10 continuous weeks of interest or fees (§ 7-23-403(1)). Terms: at least 4 equal payments over at least the greater of 90 days after default or 60 days after entering the plan, no interest or fees of any kind, no new collateral (except checks for the payments, and up to 20% initial payment if in default), no collection while the borrower complies. Request in writing no sooner than the day before the last day of the term and no later than the business day before the due date (or within 10 days after a default notice). A fee of up to $20 is allowed only if the borrower defaults on the plan (§ 7-23-403(2)-(7)).
- State loan database
- No state database; lender must report loan amount, payoff or default to a consumer reporting agency (§ 7-23-401(1)(i)).
- Limits on collection
- Lender may not threaten or use criminal process in any state to collect (§ 7-23-401(4)(f)); may not call at work if told the employer forbids it (§ 7-23-401(4)(g)). Before suing, lender must give at least 30 days' notice of default including the right to an extended payment plan (§ 7-23-401(8)). Dishonored-check remedies of ch. 7-15 apply, but the lender may not demand the extra civil damages amounts in § 7-15-1(6)(a)(iii) or (7)(b)(vi) (§ 7-23-401(5)); ch. 7-15 allows a $20 service charge and up to $35 collection costs after notice (§ 7-15-1(2)(b), (4)).
- Other rights
- Right to rescind with no charge by returning the loan amount by 5 p.m. the next business day (§ 7-23-401(3)(b)). Partial payments of at least $5 at any time with no extra charge (§ 7-23-401(3)(a)). Lender must check ability to repay (consumer report for first-time borrowers) and get a signed acknowledgment (§ 7-23-401(1)(g)-(h), (6)-(7)).
If you are behind on a payday loan in Utah
- Ask for the payment plan before the due date. Utah law gives borrowers a way to repay in installments. The details are in the table above. Ask in writing and keep a copy.
- Stop the automatic withdrawals if they are emptying your account. You can revoke the lender's permission to debit your account and tell your bank. How to do it.
- Look at a credit union payday alternative loan. Federal credit unions can lend $200 to $2,000 at much lower cost. How they work.
- Talk to a nonprofit credit counselor. A counselor can look at all your bills, not just this one. How to find a real one.
